Terms of Service

1. Provider and scope

These terms govern the use of Chatvertise ("the Service"), operated by Codeventure e.U., Mühlbachgasse 7, 4533 Piberbach, Austria ("we"). The Service is directed at businesses (B2B); by registering you confirm that you act in a commercial capacity.

2. The Service

Chatvertise is a management platform for advertising in ChatGPT, built on the OpenAI Advertiser API. We provide dashboards, campaign management, AI-assisted recommendations and related tooling. We are not affiliated with OpenAI; availability of the underlying Advertiser API, ad delivery and ad review decisions are exclusively within OpenAI's control.

3. Your ad spend

Your advertising budget is contracted and paid directly between you and OpenAI. Chatvertise never receives, holds or forwards your media spend and is not a party to your agreement with OpenAI.

4. Plans, payment, cancellation

Paid plans (Growth, Pro) are billed monthly in advance via Stripe and can be cancelled monthly through the customer portal. Prices are shown including applicable taxes where required. We may change prices with 30 days' notice effective from the next billing period.

5. Your obligations

  • Keep your credentials and connected API keys confidential; you are responsible for activity within your organization.
  • You are responsible for the persons you invite to your organization and for their actions within it. Plan-specific team limits apply.
  • Ensure your ad content complies with applicable law and OpenAI's advertising policies.
  • Custom audiences: you may only upload first-party data for which you have a valid legal basis; data from data brokers is not permitted. Uploaded lists are forwarded to OpenAI on your behalf (we act as your processor); regional restrictions imposed by OpenAI (currently no availability for users in the EEA and Switzerland) must be observed.
  • Conversion tracking: pixels and server-side events you set up run on your own website. Informing your visitors and obtaining any legally required consents is solely your responsibility.
  • Do not misuse the Service (reverse engineering, abusive load, unlawful content).

6. AI-generated content

AI-generated campaign proposals and recommendations are assistive suggestions, not guarantees of performance. You review and approve all content before activation and remain responsible for the campaigns you run.

7. Availability and liability

We aim for high availability but do not warrant uninterrupted operation, in particular where the OpenAI Advertiser API (beta) is unavailable or changes. We are liable without limitation for intent, gross negligence and personal injury. Liability for slight negligence — other than personal injury — is excluded; liability for lost profit, indirect and consequential damage is excluded to the extent legally permissible.

8. Data protection

See our Privacy Policy. A data processing agreement (DPA) for business customers is available on request at office@chatvertise.app.

9. Final provisions

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG); place of jurisdiction is the court competent for our registered seat in Piberbach, Austria, where permissible. Should individual provisions be invalid, the remainder stays unaffected.
